Legal information

DATA PROTECTION POLICY

We are responsible for the collection, processing and use of your personal data as well as for the processing of the data in accordance with the law. These data protection provisions are considered an integral part of the terms of use.

We are committed to handling your personal data responsibly. We therefore comply with the legal requirements of the Swiss Federal Data Protection Act (DPA), the Ordinance on the Federal Data Protection Act (FDPA), the Telecommunications Act (TCA) and other provisions of Swiss data protection legislation. In addition, we will comply with the provisions of the EU Basic Data Protection Ordinance on personal user data (GDPR).

In the following we would like to inform you about how we process your personal data.

The original privacy statement is in French. The translated versions are intended to facilitate better understanding. In case of discrepancies, the French text is authoritative.

Please note that the information below may be checked and changed from time to time. We therefore recommend that you regularly consult this data protection declaration. While you are visiting our website, we collect and use your personal data to the following extent for the following purposes

SCOPE AND PURPOSE OF THE COLLECTION, PROCESSING AND USE OF PERSONAL DATA

When visiting our site

When you visit our website, our servers temporarily record each access in a log file.

We record the following data:

  • the IP address of the requesting computer,
  • the date and time of access,
  • the name and URL of the data consulted,
  • the website from which it was accessed to our domain,
  • the operating system of your computer and the browser you are using,
  • the country from which the access to our website takes place and
  • the name of your Internet service provider.

The collection and processing of this data is generally done anonymously without personal reference in order to enable the use of the website (establishment of the connection), to ensure the long-term security and stability of the system and to optimize the Internet offer, as well as for statistical purposes. The above-mentioned information is not linked to personal data or stored together with it.

Only in the event of an attack on the network infrastructure or suspicion of another illegal or abusive use of the website will the IP address be analyzed for clarification and defense purposes and, if necessary, used in criminal proceedings for identification and civil and criminal proceedings against the user concerned. We may be required to provide the files in question to a state upon request if a complaint can be made.

If you subscribe to our newsletter or use any type of contact form

In order to receive the newsletter or to contact us by means of a form, the following personal data must be entered

  • your e-mail address
  • civility
  • first name
  • name
  • full address
  • phone
  • object and message

We need this information to process your request, to send you the newsletter and/or to use the data for marketing purposes as described below.

TRANSMISSION OF DATA TO THIRD PARTIES

We will only pass on your data if you have given your express consent, if we are obliged to do so by law or if it is necessary to enforce our rights. We also pass on your data to companies that are affiliated with us.

In addition, we pass on personal data of users to third parties insofar as this is necessary for the use of the website and for answering questions, processing inquiries or providing services requested by the user. The use by third parties of the data transmitted for this purpose is strictly limited to the above-mentioned purposes.

An overview of the providers in the sense of the previous paragraph can be provided on request.

USE FOR MARKETING PURPOSES

Newsletter and other marketing campaigns

By registering for the newsletter, you expressly agree that we may use your address and personal data for marketing campaigns, such as sending the newsletter and/or catalogs. You can unsubscribe from all marketing campaigns at any time. You will find the contact data under “Contacts” below. You will also find an unsubscribe link in all newsletter e-mails sent to you.

In addition, we are entitled to commission third parties with the technical development of marketing campaigns and therefore have the right to make your personal data available to third parties for this purpose.

We or third parties use e-mail marketing services to send out our newsletter, and newsletter data may be transmitted for this purpose. The newsletter data is stored both on the host server of the website and on a server of a third party company commissioned for this purpose.

Our newsletter as well as our website may contain so-called web beacons or other similar technical means. A web beacon is an invisible 1×1 pixel graphic, which is related to the user ID of the respective newsletter subscription or marketing campaign.

With each newsletter sent, there is information about the address file used, the subject and the number of newsletters sent. We can also see which addresses have not yet received the newsletter, to which address it was sent and for which addresses the sending failed. There is also the opening rate, including information about the addresses that opened the newsletter. And finally the information about the unsubscribed addresses. We use this data for statistical purposes and to optimize the newsletter in terms of content and structure. This allows us to better tailor the information and offers in our newsletter to the individual interests of the recipients. The web beacon is deleted when you delete the newsletter.

To suppress the use of the web beacon in our newsletter, please configure your mail program, if it is not already the case by default, so that no HTML is displayed in the news.

To suppress the use of the web beacon on our website, you can open a private browser. You can find more information about this in your browser’s settings options.

However, private browsing may result in you not being able to use all the features of our platform.

Re-targeting

We may use so-called re-targeting technologies on the website. The usage behavior on the website is analyzed in order to be able to offer user-specific advertising on the websites of our partners. Usage behavior is recorded under a pseudonym.

Most re-targeting technologies work with cookies (see “Cookies” section below).

Third-party companies use this information to analyze the use of the website with regard to advertisements to be placed, to compile reports on website activities and advertisements for website operators, and to provide other services related to the use of the website. They will also pass on this information to third parties, if required by law or if third parties process this data on their behalf.

Users can prevent re-targeting at any time by rejecting or deactivating the relevant cookies in the menu bar of the Internet browser (see below under “Cookies”).

TRANSFER OF PERSONAL DATA ABROAD

We are entitled to pass on your data to third-party companies abroad, insofar as this is necessary for the processing of your inquiries, the provision of services and marketing campaigns. These third-party companies are obliged to respect the privacy of users in the same way as the provider itself. If the level of data protection in a country is considered to be inappropriate for Swiss conditions or in accordance with the EU Basic Data Protection Ordinance, we will ensure, with the help of user regulations or international standards, that your personal data is protected at all times in accordance with Swiss guidelines or the EU Basic Data Protection Ordinance.

Most of the providers are located either in Switzerland or in Europe. However, some of the providers are based in the USA (see “Re-Targeting”, “Tracking Tools” and “Social Plugins”). You will find further information on the transfer of data to the USA under “Tracking”.

RIGHT TO INFORMATION, DELETION AND CORRECTION

You may request information about your personal data stored by us at any time. Requests for information must be submitted in writing with proof of identity. You also have the right to request the deletion or correction of your data stored with us at any time.

You can make a corresponding request by filling out the contact form provided for this purpose.

Users from an EU Member State may also contact their competent data protection authorities.

Please note that certain data must be stored for a certain period of time by law. Such data must therefore remain stored with us until these periods expire. We block this data in our system and only use it to comply with the legal requirements.

MENTIONS FOR CHILDREN AND PARENTS

Our website is primarily intended for an adult audience. Children under the age of 16 are not allowed to give us their personal data or to register for a service. If we become aware that such data has been transmitted to us, it will be deleted from our database. The parents (or legal guardians) of the child can contact us and request deletion or de-registration. For this purpose, we need a copy of an official document proving that you are a parent or a person in charge of the child’s education.

DATA SECURITY

We use technical and organizational security measures that we consider adequate to protect your data against manipulation, partial or total loss and unauthorized access by third parties. Our security measures are continuously adapted to the latest technological developments.

We also take our own internal data protection very seriously. Our employees and the service companies we have commissioned are obliged to maintain confidentiality and to comply with the legal provisions on data protection. Furthermore, access to personal data is only granted to the extent necessary.

COOKIES

Cookies help, among other things, to make your visit to our website easier, more enjoyable and more useful. Cookies are information files that your Internet browser automatically stores on your computer’s hard drive when you visit our website.

Cookies do not damage your computer’s hard drive and do not transmit your personal data to us.

We use cookies, for example, to recognize you as a registered user without you having to log in again each time. This use does not mean that we receive any new personal data about you as an online visitor.

Most Internet browsers accept cookies automatically. However, you can configure your browser so that no cookies are stored on your computer or so that you receive a warning when a new cookie arrives. You can find more information about this in the settings options of your browser.

However, if you disable cookies, you may not be able to use all the functions of our portal.

TRACKING-TOOLS

The website uses Google Analytics, a web analysis service provided by Google Inc. (www.google.com). Google Analytics uses methods to analyze the use of the website, such as “cookies” (see “Cookies” above). The information about the use of the website is usually transferred to a Google server in the USA and stored there.

The information is used to analyze the use of the website, to compile reports on website activities and to provide other services related to the use of the website for market research purposes and to organize the website as required.

Users can prevent the recording of the data generated by the cookie and related to the use of the website by the user concerned (including the IP address) to Google as well as the processing of this data by Google, by downloading and installing the browser plug-in available under the following link:

http://tools.google.com/dlpage/gaoptout

As an alternative to the browser plug-in, users can click on this link to prevent the collection of data by Google Analytics on the website in future. An opt-out cookie is stored on the user’s terminal. If users delete cookies (see above “Cookie”), the link must be clicked again.

For the sake of completeness, we mention that the US authorities can apply surveillance measures under US law, authorizing the general recording of all data transmitted from the European Union to the USA. This is done without distinction, restriction or exception on the basis of the purpose and without objective criteria that would allow to restrict the access of the US authorities to personal data and their subsequent use for certain strictly limited purposes that would justify the access to these data.
